Weingarten Rights

During a few weeks of December and last week, there have been some meetings with staff and administration. While some of those meetings were pretty standard, some were parts of investigations that could lead to discipline. In some of those cases, the member went to the meeting without Union representation. Under the Weingarten Ruling of 1975, an employee has a reasonable belief that discipline or other adverse consequences may result from what he or she says, the employee has the right to request union representation. However, remember that you have the right to representation, and you have to request it: Management is not required to inform the employee of his/her Weingarten rights; it is the employees responsibility to know and request.
